If parents cannot agree on a joint custody arrangement, a judge will determine who will be the primary residential parent and who will be the secondary residential parent. In Tennessee, the judge will consider the following factors to determine custody of a minor child:
- The child’s relationship with each parent
- Which parent has been the primary caregiver
- Each parent’s willingness to support the child’s relationship with the other parent
- A parent’s ability to adequately provide and care for the child
- The emotional and developmental needs of the child
- The moral, physical, mental, and emotional fitness of each parent
- The child’s relationship with relatives and the importance of stability
- Evidence of mistreatment of the child or the other parent, including abuse and neglect
- The character/behavior of any other person who lives with or frequently visits a parent
- The child’s preference if they are 12 years of age or older
- Each parent’s work schedule
- Any other factors deemed relevant by the court
