Filing for Divorce in Tennessee
The process of ending a marriage is more involved than just signing divorce papers – the courts require a thorough evaluation of your circumstances and equitable division of all marital assets. To file for divorce in Tennessee, you must first prove to the courts that your situation meets at least one of 15 grounds for divorce:
- Infertility
- Bigamy
- Adultery
- Abandonment/desertion
- Felony conviction
- Infamous crime conviction
- Attempted murder
- Refusal to move
- Pregnancy by an extramarital partner
- Alcohol or substance addiction
- Cruel and inhuman treatment
- Abuse or cruel treatment
- Abandonment or neglect
- Irreconcilable differences
- Separation of at least two years (with no minor children)
Petitions for divorce in Tennessee can be either contested or uncontested, and that will determine how the process moves forward. Uncontested divorce means that both spouses agree to the terms and will not require a judge to decide on the case. On the other hand, a contested divorce is when one spouse does not agree to some or all of the terms. In this case, you must participate in mediation prior to taking the case to family court.
